If you have suffered an injury the first step is for us to discuss with you the circumstances of your accident, and gather together details of who or what caused the injury, what injuries you suffered and any financial losses you have incurred as a result of the accident. We will then then contact the party responsible for the accident and ask them to notify their insurers. At this point of the claim we will try and establish and obtain an admission of fault for the accident. We will then need to arrange an examination by an independent medical expert on a date and time which is convenient for you. The expert will provide us with a report on the injury you have suffered which we can then use to advise you on the likely value of your compensation claim.
At this time we will also prepare a schedule of other losses you have incurred as a result of the accident. It is always advisable to keep receipts or invoices where possible and, for example, if you have been off work and lost earnings, we will ask your employer for confirmation of your loss.
Once we have all this information and you are happy with the medical report, we send these documents to the other party's insurers and ask them to make an offer to settle your claim. We will, of course, advise you how much compensation you are likely to receive and we will negotiate a settlement on your behalf,
On rare occasions if we cannot reach agreement with the insurers, because we believe the offer of damages is too low or liability is disputed, we will on your behalf issue court proceedings, it is then up to a judge to decide the correct award or compensation. Very few cases end up in a court room, most cases settle out of court after proceedings have been issued.
